These Terms of Use ("Terms") govern your access to and use of flatxsystems.com (the "Site") and any information, materials, or services described on it. The Site is operated by Flat Roof Systems Group LLC, operating as FlatX ("FlatX," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.
1. Use of the Site
You may use the Site only for lawful purposes and in a manner that does not interfere with the Site, its security, or another person's use of it. You may not attempt to gain unauthorized access to any portion of the Site, transmit malicious code, scrape or copy the Site in a way that burdens our systems, or misrepresent your identity or affiliation.
2. Services and Information
FlatX provides commercial flat-roofing services in the Portland, Oregon area. Information on the Site is provided for general informational purposes only. Nothing on the Site creates a binding proposal, estimate, statement of work, service agreement, warranty, or obligation to perform work unless confirmed in a separate written agreement, estimate, work order, invoice, or similar document signed or accepted by FlatX and the customer.
3. Inquiries and Communications
If you contact FlatX through the Site, by email, by phone, by SMS/MMS, or through another channel, you authorize us to contact you by email, phone, text message, or other reasonable business channels regarding your inquiry, inspections, estimates, appointments, projects, payments, and related services. Submitting a request does not require you to purchase services and does not require FlatX to accept or perform an engagement.
If you receive text messages from FlatX, message and data rates may apply. You can reply STOP to opt out of supported text messages and HELP for help where those options are made available. Opting out of marketing or non-essential messages may not stop transactional, administrative, service, safety, security, billing, or legally required communications.
4. Separate Customer Agreements
These Terms govern use of the Site. Roofing services, inspections, estimates, deliverables, timelines, fees, payment terms, deposits, warranties, maintenance obligations, safety requirements, property access, change orders, cancellations, confidentiality, data handling, and other project-specific terms are governed by the applicable written agreement, estimate, work order, invoice, payment terms, warranty document, or similar customer document.
5. User Submissions
If you submit business information, property information, photos, videos, roof records, messages, access instructions, payment information, or other materials to FlatX, you represent that you have the right to provide them and that the information is accurate to the best of your knowledge. You grant FlatX the limited right to review, store, process, and use those materials as reasonably necessary to respond to your inquiry, evaluate a potential project, provide services, maintain business records, collect payment, support warranty or insurance matters, and comply with legal obligations.
6. Jobsite Access, Safety, and Documentation
Roofing work may require access to buildings, roofs, yards, equipment, tenants, occupants, utilities, parking areas, and other property features. Customers are responsible for providing accurate access instructions, identifying known hazards, securing required permissions, and ensuring that FlatX can reasonably access the work area. FlatX may document site conditions, work progress, safety issues, damage, completion, and related matters through notes, photos, videos, measurements, and similar records.
7. Ownership
The Site and its content, including text, graphics, design, branding, and the selection and arrangement of those materials, are owned by FlatX or its licensors and are protected by intellectual property laws. Except as permitted by law or by written permission from FlatX, you may not copy, modify, distribute, display, or create derivative works from the Site or its content.
8. Third-Party Services
The Site and FlatX services may reference, link to, or use third-party platforms, including hosting providers, cloud services, communications systems, SMS/MMS providers, call recording tools, scheduling tools, customer-management systems, payment processors such as Stripe, accounting tools, mapping services, and document services. FlatX does not control third-party services and is not responsible for their availability, content, privacy practices, security, or performance.
9. Privacy
Our collection, use, sharing, retention, and protection of personal information is described in our Privacy Policy. The Privacy Policy is incorporated into these Terms by reference.
10. Disclaimer of Warranties
The Site is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, FlatX disclaims all warranties regarding the Site, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. FlatX does not warrant that the Site will be uninterrupted, secure, or error-free.
Any warranties, workmanship commitments, product warranties, manufacturer warranties, or project-specific remedies related to roofing services are governed only by the applicable written estimate, agreement, warranty document, invoice, or other customer document.
11. Limitation of Liability
To the fullest extent permitted by law, FlatX and its owners, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or other intangible losses arising out of or relating to your access to or use of the Site.
12. Changes to These Terms
FlatX may update these Terms from time to time by posting revised Terms on the Site and updating the effective date above. Your continued use of the Site after the revised Terms take effect constitutes acceptance of the revised Terms.
